Judy Miller Defends Leaker -- Of Harry Potter Ending!

By E&P Staff -- NEW YORK -- Judith Miller, the former New York Times reporter who is something of an expert on leaks, was asked today on the Fox News show "Fox and Friends" about the burning issue of the day: Who leaked the pages from the new Harry Potter book and does she defend the leaker?

Miller said she didn't think the leaker giving away the ending of the book was the right thing to do but added, chuckling, "I would defend to the death his right to do it."

By David Edwards and Muriel Kane -- When New York Times reporter Judith Miller visited Fox News on Wednesday, the first question put to her was whether leaking the ending of the last Harry Potter book was a criminal act.

Asked, "Obviously, you would not agree with somebody exposing all these details," Miller -- who went to jail while refusing to testify in the Valerie Plame leak case -- replied, "No, I wouldn't, but I would defend to the death his right to do it."

Was Judith Miller’s Trip to Jail Necessary?

Now that the dust has settled in the I. Lewis (“Scooter”) Libby trial, was it necessary to have put Judith Miller in jail? The answer is no.

Special Prosecutor Patrick Fitzgerald did not need her. He had plenty of other witnesses to convict Mr. Libby without her. He had seven government employees and two journalists (Matt Cooper and Tim Russert) to say Mr. Libby lied.

Further, Mr. Fitzgerald knew he had these witnesses before forcing Ms. Miller, against her will, to become an additional one. All these witnesses testified at the grand jury before Ms. Miller was subpoenaed. She was virtually the last.

Mr. Fitzgerald should have stopped, looked and listened before provoking a major press controversy by jailing Ms. Miller. But he did not.

THE CONVICTION of I. Lewis Libby on charges of perjury, making false statements and obstruction of justice was grounded in strong evidence and what appeared to be careful deliberation by a jury. The former chief of staff to Vice President Cheney told the FBI and a grand jury that he had not leaked the identity of CIA employee Valerie Plame to journalists but rather had learned it from them. But abundant testimony at his trial showed that he had found out about Ms. Plame from official sources and was dedicated to discrediting her husband, former ambassador Joseph C. Wilson IV. Particularly for a senior government official, lying under oath is a serious offense. Mr. Libby's conviction should send a message to this and future administrations about the dangers of attempting to block official investigations. . . .
